پيشگفتار

انتخابات بارزترین و قابل اندازه‌گیری‌ترین نوع مشارکت افراد در عرصه سیاسی و مسالمت آمیزترین شیوه برای دستیابی به قدرت در عرصه سیاسی می‌باشد. بی‌تردید مفهوم «انتخابات پاک» ضرورتی آشکار در حقوق انتخاباتی را مطرح می‌کند.
افزایش مخارج انتخاباتی نتیجه بلافصل افزایش عملیات جذب پول یا به عبارت مرسوم، ثمره افزایش بی‌رویه منابع تامین مالی احزاب سیاسی و نامزدهاست. در عین حال که وجود پول حتی برای انجام یک رقابت سیاسی حداقلی لازم و ضروری است، اما نفوذ بی‌رویه آن در رقابت‌های سیاسی، انتخابات را که باید مجرای موثق انتقال قدرت سیاسی در حکومت دمکراتیک باشد، به ورطه فساد کشانده و ضمن حیف و میل مبالغ هنگفت و نجومی پول- که بعضا نیز از کیسه بیت المال جبران می‌شود- سلامت آن را دستخوش تخدیش می‌کند.
«انتخابات پاک» بر انتخاباتی ساده و بی‌آلایش و عاری از نفوذ متمولان بر رقبا و رقابت‌های سیاسی دلالت دارد و رقابت در آن صرفاً برای اشارت بر توانایی‌ها و استعدادهای شخصی با توسل حدقلی به پول است. تلاش تمام نظام‌های حقوقی آن است که نفوذ پول در سیاست و هزینه‌ها و مخارج انتخاباتی و نتیجتا فساد سیاسی را به حداقل ممکن برسانند.
در نظام حقوقی جمهوری اسلامی ایران با اینکه در مورد نهاد انتخابات سابقه روشن و درخشانی کسب شده، اما نگاهی هر چند کوتاه به حجم اندک مقررات انتخاباتی ایران کافی است تا متوجه شویم که نظام حقوقی کشورمان در این زمینه فقیر و نارسا است.
در کتاب پیش رو سعی گردیده راهکارها و پیشنهادهایی جهت شفافیت در هزینه‌های مالی کاندیداها نظیر تدوین قوانین خاص یا اصلاح قوانین موجود، پیش‌بینی شورای نظارت بر هزینه‌های انتخابات، پیش‌بینی یارانه دولتی برای احزاب قانونی یا کاندیداها، تعیین ذیحساب مالی متعهد و … مطرح گردیده است.

“Clean elections” refers to a simple and untainted election, free from the influence of the rich on rivals and political competitions, and the competition in it is only to indicate personal abilities and talents by resorting to money. The effort of all legal systems is to minimize the influence of money in politics and election expenses and political corruption as a result.
In the legal system of the Islamic Republic of Iran, even though there is a clear and brilliant record regarding the institution of elections, but a brief look at the small volume of Iran’s electoral regulations is enough to realize that the legal system of our country is poor and inadequate in this field.
