پیشگفتار

فرزندخواندگي نهادي فقهي- حقوقي است كه طبق آن رابطه خاصي ميان فرزندخوانده، پدرخوانده و مادرخوانده بوجود مي‌آيد، اين موضوع در مدت تاريخ سابقه‌ای نسبتا طولاني دارد و در دوره‌های مختلف با اهداف گوناگون و اشكال متفاوت مورد توجه قرار گرفته است.
در اين زمينه بررسي آيات قرآن ما را متوجه خواهد ساخت همچنانکه در دين مبين اسلام مشروعيتي براي فرزندخواندگي قابل تصور نبوده است و در دين اسلام محلي از اعراب ندارد و احكام منوط به اين امر هرچند در صدر اسلام مورد پذيرش جامعه بوده گرچه، با ظهور اسلام اين رابطه و احكام رفع شده و جايگاه خود را در جامعه اسلامي از دست داده است.
وجود فرزند، يكي از نياز‌هاي ضروری در هر خانواده است تا حضور فرزند به كانون آن خانواده گرما ببخشد. گاه این موضوع آنچنان در خانواده¬ها ضرورت پیدا می¬کند که خانواده¬هایی که به دلایل مختلف از داشتن فرزند محروم هستند، در صدد چاره بر می¬آیند. در چنین شرایطی موضوع فرزندخواندگی مطرح می‌شود.
موضوع دیگر آنکه کودکان بدپرست و یا بدون سرپرست نیز نیاز ضروری و مبرم دارند که گرمای وجود خانواده را حس کنند. به همین جهت با پشتیبانی و حمایت درست و قانونی این دو گروه قادر به تشکیل خانواده¬ای گرم، کامل و صمیمی خواهند بود تا نیازها و احتیاجات دو طرف مرتفع گردد. در همین راستا، به منظور پشتیبانی از کودکان بد سرپرست و بدون سرپرست، قوانینی توسط قانونگذار به تصویب رسیده است. همان گونه که بعد از سال‌ها نقص در قوانین، «قانون حمایت از کودکان بدون سرپرست و بد سرپرست» در سال ۹۲ به منظور پشتیبانی از این قشر تصویب شد.
تلاش مولف در این کتاب بر آن بوده است که با توصیف و تحلیل به مفاهیمی از جمله وارث، حضانت، نفقه و نکاح در قانون جدید پرداخته شود. با مدنظر قرار دادن نتايج حاصل از اين کتاب، امکان رفع بسیاری از شبهات موجود در اين زمينه وجود خواهد داشت.

Abstract

Adoption is a juridical-legal institution according to which there is a special relationship between the adopted child, the adoptive father and the adoptive mother. This issue has a relatively long history and has been considered in different periods with different goals and different forms.
In this context, the examination of the verses of the Quran will make us realize that in the religion of Islam, there was no legitimacy for adoption, and in the religion of Islam there is no place for Arabs, and the provisions related to this matter were accepted by the society at the beginning of Islam, although, with the advent of Islam This relationship and rules have been removed and it has lost its place in the Islamic society.
The existence of a child is one of the essential needs in every family, so that the presence of a child warms the center of that family. Sometimes this issue becomes so necessary in families that families who are deprived of having children for various reasons seek a solution. In such a situation, the issue of adoption is raised.
Another issue is that abused children or those without guardians also have an urgent and urgent need to feel the warmth of a family. For this reason, with the right and legal support, these two groups will be able to form a warm, complete and intimate family so that the needs and requirements of both parties are met. In this regard, laws have been approved by the legislator in order to support children with bad guardians and without guardians. Just as after years of deficiencies in the laws, the “Law for the Protection of Children Without Guardians and Bad Guardians” was approved in 1992 in order to support this group.
The author’s effort in this book has been to describe and analyze concepts such as inheritance, custody, alimony and marriage in the new law. By considering the results of this book, it will be possible to clear many doubts in this field.
