پیشگفتار

حمایت حقوقی و قضائی از افراد معلول اشاره به حقوق افراد معلول در بهره‌مند شدن از تمامی امکانات قانونی و قضائی، باتوجه به نوع و شدت معلولیت، بدون هیچ‌گونه تبعیض، برای دست‌یابی به عدالت، به شکل مستقیم و غیرمستقیم، دارد.
معلولیت از دید تاریخی برای جوامع به عنوان یک چالش به حساب می‌آمده است و همواره سیاست‌ها و رفتارها با این اقشار، بسته به دوره‌ها و سلایق اصحاب قدرت متغیر بوده است، امروزه نهادهای بین‌المللی و اعلامیه حقوق بشر و کنوانسیون حمایت از افراد معلول فضای قبلی را تغییر داده و اکثر کشورها تحت تأثیر این کنوانسیون‌ها تغییراتی را در رویکردهای خود ایجاد کرده‌اند.‌
در این پژوهش، ماهیت حقوق افراد معلول از جنبه‌های مختلف مورد بررسی قرار گرفته و قوانین حمایتی از افراد معلول، با تکیه بر کنوانسیون حمایت از افراد معلول و اعلامیه حقوق بشر و در راستای آن، نوع اثرگذاری قوانین فوق بر سیاست‌ها و قوانین داخلی مدنظر قرار گرفته است.
منابع مورد بررسی در این کتاب شامل کنوانسیون‌های حقوق بشر، کنوانسیون حمایت از افراد معلول (سی. آر. پی. دی)، قانون مجازات اسلامی، آیین دادرسی کیفری و مدنی و در نهایت قانون جامع حمایت از افراد معلول که به عنوان اصلی‌ترین قانون در جهت حمایت از افراد معلول در سال ۸۳ مورد تصویب قرار گرفته است، خواهند بود. در این کتاب بررسی حمایت حقوقی- قضائی مدنظر بوده و همواره اهداف مشخص کتاب شامل بررسی نزدیکی سیاست‌های تقنینی کنوانسیون سی. آر. پی. دی و ایران در مورد حمایت حقوقی و قضایی از معلولان و بررسی اثرگذاری سیاست‌های تقنینی کنوانسیون‌های سی. آر. پی. دی بر ایران در مورد حمایت حقوقی و قضایی از معلولان می‌باشد.
عمده موانع سیاست‌های حمایتی کنوانسیون، به عدم شفافیت برخی قوانین و عدم الزام‌آور بودن آن می‌باشد، این درحالی است که عامل ناکامی سیاست‌ها و قوانین داخلی، به دلیل عدم شناسایی افراد معلول، در تمامی قوانین و به دنبال آن، عدم تدوین قوانین و بکارگیری سیاست‌های نظامند و یکپارچه با استفاده از تمامی منابع جامعه می‌باشد.
رویکردهای تحلیلی در این کتاب، مقایسه مقررات کنوانسیون حمایت از افراد معلول با قوانین حمایتی و بررسی خلاءها، انطباق‌ها و نوع تأثیرپذیری قوانین داخلی از کنوانسیون‌های حمایت از افراد معلول می‌باشد.

Abstract

Legal and judicial protection of persons with disabilities refers to the rights of persons with disabilities to enjoy all legal and judicial facilities, according to the type and severity of disability, without any discrimination, to achieve justice, directly and indirectly.
Disability has historically been considered a challenge for societies, and policies and attitudes towards these groups have always varied depending on the eras and tastes of those in power. و and most countries have changed their approaches under the influence of these conventions.
In this study, the nature of the rights of persons with disabilities is examined from different aspects and the laws protecting persons with disabilities, based on the Convention on the Protection of Persons with Disabilities and the Universal Declaration of Human Rights and, accordingly, the impact of these laws on domestic policies and laws. has taken.
The sources studied in this book include the Human Rights Conventions, the Convention for the Protection of Persons with Disabilities (CRPD), the Islamic Penal Code, the Code of Criminal and Civil Procedure, and finally the Comprehensive Law for the Protection of Persons with Disabilities, which is the main law in Approved in 1983 to support people with disabilities. In this book, the study of legal-judicial protection is considered and always the specific goals of the book include the study of the closeness of the legislative policies of the C Convention. R. پی. The analytical approaches in this book are to compare the provisions of the Convention on the Protection of Persons with Disabilities with the protection laws and to examine the gaps, adaptations and the type of impact of domestic laws on the conventions on the protection of persons with disabilities.
